TERMS OF SERVICE

1. OPERATOR AND ACCEPTANCE
These Terms of Service govern access to and use of Poliora Publisher, a web-based service operated by:

By accessing or using Poliora Publisher, you confirm that you have read, understood, and agreed to these Terms of Service and the Privacy Policy.
If you do not agree to these Terms, you must not use the service.
2. ELIGIBILITY AND AUTHORIZED ACCESS
You must be at least 18 years old and legally capable of entering into a binding agreement to use Poliora Publisher.
The current version of the service is available only to authorized users. Public self-registration is not currently available.
You must provide accurate information when access is granted and must not impersonate another person or organization.
You may use Poliora Publisher only for accounts and content that you own or are legally authorized to manage.
3. DESCRIPTION OF THE SERVICE
Poliora Publisher allows authorized users to perform activities that may include:
- connecting an authorized TikTok account;
- uploading and organizing media;
- preparing captions, hashtags, visibility choices, and interaction settings;
- publishing or scheduling user-selected content;
- tracking publishing and processing status;
- disconnecting connected platform accounts;
- optionally generating caption suggestions using artificial intelligence.
Features may be changed, limited, suspended, or removed as the service develops.
The availability of a feature in the interface does not guarantee that TikTok or another third-party provider will accept or complete the requested operation.
4. TIKTOK CONNECTION AND AUTHORIZATION
TikTok accounts are connected through TikTok’s authorization process.
By connecting a TikTok account, you confirm that:
- you own the account or have permission to manage it;
- the authorization information you provide is accurate;
- Poliora Publisher may use the permissions granted by you to perform the actions you request;
- you remain responsible for activity performed through the connected TikTok account.
You may disconnect Poliora Publisher through the service where that option is available or revoke access through your TikTok account settings.
Disconnecting an account may not automatically delete historical publishing records, status information, or media associated with completed operations.
5. USER CONTENT
“User Content” includes videos, images, captions, hashtags, filenames, metadata, instructions, and other materials uploaded, entered, selected, or submitted through Poliora Publisher.
You retain ownership of your User Content.
You grant Poliora Publisher a limited, non-exclusive, worldwide, royalty-free license to host, copy, process, modify for technical compatibility, transmit, and submit User Content only as necessary to:
- provide the service;
- create previews and thumbnails;
- prepare requested posts;
- publish or schedule content according to your instructions;
- generate optional caption suggestions;
- maintain publishing history and diagnose failed operations.
This license ends when the content is deleted and no longer reasonably required for service operation, legal compliance, security, backups, or records of completed publishing activity.
6. USER RESPONSIBILITY FOR CONTENT
You are solely responsible for User Content and for ensuring that you have all necessary rights, permissions, licenses, and consents.
You must not upload or publish content that:
- infringes copyright, trademark, privacy, publicity, or other rights;
- is illegal, fraudulent, deceptive, defamatory, threatening, or abusive;
- contains malware, malicious code, or instructions intended to compromise systems;
- violates TikTok rules, community guidelines, advertising policies, or API policies;
- constitutes spam, artificial engagement, unauthorized advertising, or platform manipulation;
- contains personal data that you are not legally permitted to process or publish;
- exploits or endangers children;
- promotes illegal goods, services, or activities.
Poliora Publisher may refuse, suspend, or remove access where content or conduct appears to violate these Terms or applicable law.
7. PUBLISHING INSTRUCTIONS
Poliora Publisher acts only on instructions initiated or configured by the user.
You are responsible for checking before publishing:
- the selected TikTok account;
- the media file;
- caption and hashtags;
- visibility level;
- comment, duet, and stitch settings;
- scheduled date, time, and timezone;
- any other publishing options.
Scheduled instructions may be processed automatically at the time selected by the user.
You acknowledge that network delays, expired authorization, TikTok restrictions, processing errors, or provider outages may delay or prevent publication.
A local status shown by Poliora Publisher does not override the final status determined by TikTok.
8. OPTIONAL AI CAPTION GENERATION
Poliora Publisher may provide an optional feature that sends user instructions and limited media context to OpenAI to generate caption suggestions.
AI-generated text may be inaccurate, incomplete, inappropriate, or unsuitable.
You are responsible for reviewing, editing, and approving generated text before using or publishing it.
Poliora Publisher does not guarantee the accuracy, originality, legality, or suitability of AI-generated content.
You must not submit confidential information, sensitive personal data, or content you are not authorized to process unless doing so is necessary and lawful.
9. ACCOUNT AND SECURITY RESPONSIBILITIES
You are responsible for:
- keeping login credentials confidential;
- preventing unauthorized access to the service;
- signing out from devices you do not control;
- promptly reporting suspected unauthorized access;
- maintaining the security of connected TikTok accounts.
You must not share access credentials with unauthorized persons or attempt to bypass authentication, access restrictions, rate limits, or security controls.
10. PROHIBITED USE
You must not:
- use Poliora Publisher for illegal or unauthorized purposes;
- access data, accounts, media, or systems belonging to another user without authorization;
- interfere with or disrupt the service or its infrastructure;
- probe, scan, or test vulnerabilities without written permission;
- reverse engineer the service except where applicable law expressly permits it;
- use automated tools to overload, scrape, or abuse the service;
- circumvent TikTok limitations, approval requirements, or platform safeguards;
- misrepresent Poliora Publisher as being owned, endorsed, or operated by TikTok;
- use the service in a way that may expose the operator or third parties to legal liability.
11. THIRD-PARTY SERVICES
Poliora Publisher depends on third-party services, including TikTok and, when selected by the user, OpenAI.
Your use of those services is also governed by their own terms, policies, technical restrictions, and account requirements.
Third-party providers may:
- reject or remove content;
- restrict visibility;
- suspend accounts;
- change their APIs or permissions;
- experience outages or processing delays;
- stop supporting a feature.
Poliora Publisher does not control and is not responsible for independent decisions, systems, or processing performed by third-party providers.
12. INTELLECTUAL PROPERTY
Poliora Publisher, including its software, interface, branding, text, graphics, and original materials, is owned by or licensed to the operator and is protected by applicable intellectual-property laws.
These Terms do not transfer ownership of Poliora Publisher or its intellectual property to the user.
You may not copy, reproduce, distribute, sell, license, or create derivative products from the service except where expressly permitted by law or authorized in writing.
The Poliora Publisher name and icon must not be used in a misleading manner or without permission.
13. PRIVACY
Personal-data processing is described in the Poliora Publisher Privacy Policy.
By using the service, you acknowledge that information must be processed to authenticate access, connect TikTok accounts, store media, perform publishing instructions, maintain security, and provide status information.
14. SERVICE AVAILABILITY AND CHANGES
Poliora Publisher is provided on an “as available” basis.
We may perform maintenance, introduce limits, modify features, or temporarily suspend parts of the service for security, legal, operational, or technical reasons.
We do not guarantee:
- uninterrupted or error-free availability;
- permanent availability of any feature;
- successful publication of every post;
- any specific processing time;
- any level of reach, views, engagement, followers, revenue, or monetization;
- compatibility with every device, file, browser, or TikTok account;
- continued availability of third-party APIs.
Where reasonably possible, material service changes will be communicated through the website or service.
15. SUSPENSION AND TERMINATION
We may suspend or terminate access where:
- these Terms are violated;
- access is unauthorized;
- the service is used illegally or abusively;
- continued access creates a security, legal, or operational risk;
- required by law or a third-party platform;
- the service or relevant feature is discontinued.
You may stop using the service and disconnect connected TikTok accounts at any time.
Termination does not automatically remove obligations, liabilities, publishing history, or records that must reasonably be retained for security, legal compliance, completed operations, or legal claims.
16. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, Poliora Publisher is provided without express or implied warranties.
We do not warrant that:
- the service will always be available, secure, or error-free;
- defects will always be corrected;
- content will be accepted or published by TikTok;
- scheduled publication will occur at an exact time;
- generated captions will be accurate or legally safe;
- data loss, interruption, or third-party failure will never occur.
Nothing in these Terms excludes rights or warranties that cannot legally be excluded.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the operator is not liable for indirect, incidental, consequential, special, or punitive losses arising from:
- third-party platform decisions or outages;
- rejected, removed, delayed, or restricted content;
- loss of reach, engagement, revenue, followers, or business opportunity;
- unauthorized use caused by the user’s failure to protect credentials;
- inaccurate or inappropriate AI-generated suggestions;
- content uploaded or published by the user;
- events beyond the operator’s reasonable control.
Nothing in these Terms limits liability where limitation is prohibited by law, including liability for intentional misconduct or other liability that cannot legally be excluded.
18. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of Poland, without prejudice to mandatory rights available under applicable consumer or data-protection law.
Before starting formal proceedings, users are encouraged to contact yurykierowca@gmail.com so that the issue may be reviewed and an amicable solution attempted.
Any dispute that cannot be resolved amicably will be handled by a court having jurisdiction under applicable law.
19. CHANGES TO THESE TERMS
We may update these Terms when the service, applicable law, or third-party requirements change.
The effective date at the top of the page will be updated when a revised version is published.
Continued use after an updated version becomes effective constitutes acceptance where permitted by law. Where separate notice or consent is legally required, it will be requested.
